General Comment No. 27: Freedom of Movement

The Human Rights Committee regularly publishes its interpretation of the content of human rights provision contained in the International Covenant on Civil and Political Rights in the form of General Comments. The Committee's "General Comment No. 27: Freedom of Movement" was published in 1999 and elaborates on Article 27 of the Convention, which specifies the right to freedom of movement. The General Comment emphasizes the right of everyone "lawfully within a territory of a State" to enjoy the freedom of movement, which includes the freedom to leave one's own country and to reenter it again. According to the General Comment, the right to freedom of movement also encompasses the right to obtain the documents required to travel outside of one's own country in a timely manner, ensuring that this is done in a non-discriminatory fashion.
