General Comment No. 21: Humane Treatment of People Deprived of Liberty

The Human Rights Committee regularly publishes its interpretation of the content of human rights provision contained in the International Covenant on Civil and Political Rights in the form of General Comments. The Committee's "General Comment No. 21: Humane Treatment of People Deprived of Liberty" published in 1992 elaborates on Article 10 of the Convention concerning the humane treatment of persons deprived of liberty. The General Comment specifies that Article 10 applies to anyone deprived of liberty, including those in prison, hospitals, detention camps or correctional institutions. It also notes that Article 10 complements Article 7 of the Convention, which bans torture and cruel treatment or punishment. Specifically, persons deprived of liberty are not to be "subjected to any hardship or constraint other than that resulting from the deprivation of liberty; respect for the dignity of such persons must be guaranteed under the same conditions as for that of free persons." This right is to be applied without discrimination, and should have as a goal the "social rehabilitation" of those deprived of liberty.
